Back Again! The upcoming 2019 Florida Legislative Session

For those of you new to the Community Association Network (CAN), you might be wondering - what exactly is the Florida Legislative Session and why should you care? Like the federal government, the Florida Legislature is composed of a Senate and a House of Representatives. The House of Representatives is made up of 120 elected State Representatives. The Senate is made up of 40 State Senators. The primary purpose of the Legislature is to enact new laws or amend/repeal existing laws. Once a year, the Florida Legislature meets for 60 days in the Florida State Capitol in Tallahassee. We at CAN, along with our partners, hold our breathe each year during this time fighting to ensure only reasonable laws are passed that affect those living and owning HOAs, condos, townhomes, cooperatives and mobile home communities.


This year, the Legislative Session begins on March 5, 2019 and is expected to end on May 3, 2019. Here at the Community Association Network, we are always keeping a watchful eye on what proposed bills may affect the millions of Floridians residing in over 47,900 community associations state-wide - the largest number of community associations in the nation.



One bill of concern that was recently filed is House Bill 155, also known as the "Community Recall Act." This HOA bill states that any member of the board of directors may be recalled and removed from office with or without cause by a majority of the total voting interests but the voting interests must physically reside in the community. This is just another attempt at trying overregulate HOAs through statutes when your governing documents should control. As usual, we may call upon you and CAN's state-wide Advisory Board to lead the effort to keep this proposed bill from getting on the floor. Together as one collective voice, we have the power to shape the laws that affect the associations we call home.
